General terms and conditions of use and reservation<\/strong><\/h1>\n

 <\/p>\n

1. Background and scope<\/h2>\n

These Terms and Conditions govern the use of the website, application, and any digital tools related to the reservation platform for quota access to the beaches of Cala Brandinchi<\/strong> and Lu Impostu<\/strong>, in the Municipality of San Teodoro.<\/p>\n

Access to the affected beaches is subject to compulsory reservation during the periods established by the Municipality of San Teodoro and in accordance with the applicable municipal regulations, applicable ordinances and the provisions published on the platform.<\/p>\n

The technical and operational management of the booking platform and related access verification services is carried out by Oikos Servizi S.r.l.<\/strong>, according to the terms defined with the Municipality of San Teodoro.<\/p>\n

Use of the site, application, or related tools implies acceptance of these Terms and Conditions. The user is therefore urged to read them carefully before making a reservation. <\/p>\n

2. Definitions<\/h2>\n

For the purposes of these Terms and Conditions:<\/p>\n

\"User\" means<\/strong> the person who uses the platform and\/or makes a reservation for himself\/herself or for other persons for whom he\/she claims to be authorized to act.<\/p>\n

\"Platform\" means<\/strong> the website, application, widgets, digital tools and any other authorized channels for managing reservations.<\/p>\n

\"Reservation\" means<\/strong> a request for access to one of the affected beaches, for a specific date and for a specific number of people.<\/p>\n

\"Booking Confirmation\" means<\/strong> the communication sent to the user, usually by e-mail, containing the booking details, QR code and\/or order number.<\/p>\n

\"QRCode\":<\/strong> the digital code associated with the reservation, to be shown to the staff in charge of access control.<\/p>\n

\"Beach regulations\" means<\/strong> the municipal regulations, ordinances and requirements in effect on the date of reservation and\/or beach access.<\/p>\n

\"Environmental fee\" means<\/strong> the amount, if any, due for beach reservation and access, according to the approved and published rates.<\/p>\n

3. User requirements<\/h2>\n

You represent that you are of legal age, have the legal capacity to accept these Terms and Conditions, and use the platform in accordance with applicable law.<\/p>\n

The user who makes a reservation on behalf of other persons declares that he\/she is authorized to provide the relevant data and agrees to inform such persons of the conditions applicable to the reservation and access to the beach.<\/p>\n

4. Permitted use of the platform<\/h2>\n

The platform may be used exclusively for personal and non-commercial purposes, for the sole purpose of requesting and managing reservations for access to the relevant beaches.<\/p>\n

It is forbidden to use the platform for illegal, fraudulent, speculative purposes or otherwise not in accordance with these Terms and Conditions.<\/p>\n

The resale, transfer, unauthorized intermediation or any other form of commercial exploitation of reservations, even if carried out free of charge or through unauthorized sites, applications, platforms or third parties, is expressly prohibited.<\/p>\n

The reservation is personal, non-transferable to third parties, and may be used only by the applicant and the persons named or included in the reservation.<\/p>\n

5. Method of reservation<\/h2>\n

Reservations must be made exclusively through authorized official channels.<\/p>\n

During the booking process the user has the opportunity to check the data entered and correct any errors before final confirmation. It is the user's responsibility to carefully check the correctness of the selected beach, date, number of people, e-mail address and any other required information. <\/p>\n

Reservations are subject to availability of places for the selected beach and date. Simply filling out the form does not guarantee the right of access until completion of the required procedure, including any payment of the environmental fee. <\/p>\n

6. Reservation limits<\/h2>\n

Each reservation can be made within the maximum number of people stipulated by the platform and current regulations.<\/p>\n

Unless otherwise posted on the platform or provided for in municipal regulations, a single user cannot make more than one reservation per day for the same access date.<\/p>\n

The categories entitled to free, reduced or special access conditions, such as but not limited to residents, TARI enrollees, guests of accommodations, persons with disabilities or minors, are governed by the municipal regulations and the fee schedule in effect at the time of booking.<\/p>\n

The user is required to correctly select the relevant category and provide truthful data. In case of incorrect, incomplete or unverifiable statements, the reservation may be cancelled or access may be denied. <\/p>\n

7. Prices, reductions and payment<\/h2>\n

Any environmental fee due for the reservation is indicated during the purchase process, prior to final confirmation.<\/p>\n

The rates, reductions and exemptions are those established by the City of San Teodoro and published on the platform or in the current municipal acts.<\/p>\n

Payment can only be made online using the payment instruments indicated on the platform, including credit, debit or prepaid cards.<\/p>\n

Payments are processed through authorized payment platforms, including Nexi or other designated payment service provider. Full payment card details are not stored by the booking platform, but are processed directly by the payment service provider according to its own security standards. <\/p>\n

After the temporary allocation of seats, the user must complete the payment within the deadline specified by the platform. If payment is not made by that deadline, the request may be cancelled automatically and the seats will become available again for other users. <\/p>\n

8. Confirmation of reservation<\/h2>\n

The reservation is considered finalized only when the Booking Confirmation is sent to the e-mail address provided by the user or through another channel provided by the platform.<\/p>\n

Confirmation of Reservation constitutes title to access to the reserved beach, within the limits and conditions stated in the confirmation itself and in the current regulations.<\/p>\n

The user is responsible for the correctness of the e-mail address and other contact information entered. Oikos Servizi S.r.l. and the Municipality of San Teodoro are not responsible for the non-receipt of the communication if this is due to incorrect data, full box, spam filters, provider blockages, user's device problems or other causes not attributable to the platform. <\/p>\n

If the QRCode is not received, the user may use the assistance tools indicated on the site or produce, if provided, the order number associated with the reservation.<\/p>\n

9. Beach access<\/h2>\n

To access the beach, the user must show the QRCode associated with the reservation or, where permitted, the reservation order number to the staff in charge.<\/p>\n

The staff in charge may carry out checks on the validity of the reservation and, where necessary, request documentation to verify entitlement to any concessions, reductions or exemptions.<\/p>\n

All persons included in the same reservation must access the beach at the same time. Separate access, fractional use, duplicate or multiple use of the same QRCode or order number are not allowed. <\/p>\n

The QRCode is valid only for the beach, date, and persons indicated in the reservation. Once used, it may not be reused for further access, unless otherwise expressly stated in the regulations or by authorized personnel. <\/p>\n

Reservations provide access to the beach, but do not include any charges for parking, transportation, bathhouse services, equipment rental, or other services not specifically mentioned.<\/p>\n

10. Obligations of the beach user<\/h2>\n

The user agrees to abide by municipal regulations, current ordinances, signs on site, and the directions of control personnel.<\/p>\n

It is the user's responsibility to inquire in advance about the access rules, prohibitions and requirements applicable to the reserved beach.<\/p>\n

Violation of the regulations, ordinances, or directions of the assigned personnel may result in denial of access, removal from the beach, and\/or application of the penalties provided for in current regulations, with no right to a refund.<\/p>\n

11. Cancellation, anti-fraud checks and misuse<\/h2>\n

Oikos Servizi S.r.l. and the Municipality of San Teodoro reserve the right to cancel reservations, deny access to the platform or prevent the use of the reservation in case of:<\/p>\n

  • False, incomplete or unverifiable data;<\/li>\n
  • Misuse of the platform;<\/li>\n
  • multiple reservations not allowed;<\/li>\n
  • Attempts to circumvent access limits;<\/li>\n
  • Unauthorized resale or transfer of the reservation;<\/li>\n
  • well-founded suspicion of fraud, abuse, or automated use of the platform;<\/li>\n
  • Failure to comply with these Terms and Conditions or municipal regulations.<\/li>\n<\/ul>\n

    In such cases, the user will not be entitled to reimbursement, unless otherwise evaluated by the operator or otherwise mandatory provision of law.<\/p>\n

    12. Bad weather, impediments and non-use<\/h2>\n

    The reservation is valid only for the selected date.<\/p>\n

    In case of non-use of the reservation due to user's choice, delay, personal inability, date selection error, unfavorable weather conditions, or other causes not attributable to the operator, there is no refund, replacement, date shifting, or issuance of a new admission ticket.<\/p>\n

    Any different arrangements may be made only in exceptional cases and will be communicated through official channels.<\/p>\n

    13. Exclusion of the right of withdrawal<\/h2>\n

    The reservation concerns a service related to access to a beach on a specific date.<\/p>\n

    Therefore, once the Booking Confirmation has been received, the user acknowledges that he\/she will not be able to exercise the right of withdrawal or request cancellation with refund of the price paid, pursuant to Article 59, paragraph 1, of Legislative Decree No. 206 of September 6, 2005, in cases where the conditions provided by the applicable regulations for services concerning leisure activities with specific date or period of performance are met. <\/p>\n

    This is without prejudice to any mandatory provisions of the law or specific official communications of the City of San Teodoro.<\/p>\n

    14. Privacy and processing of personal data<\/h2>\n

    Users' personal data are processed in accordance with the privacy policy published on the platform.<\/p>\n

    You are encouraged to review the privacy policy before proceeding with your reservation.<\/p>\n

    The data provided will be processed for purposes related to managing the reservation, payment, sending confirmation, access control, assisting users and fulfilling legal obligations.<\/p>\n

    15. Intellectual Property<\/h2>\n

    All content on the platform, including text, images, logos, graphic elements, layouts, software, databases and information materials, is protected by national and international intellectual and industrial property laws.<\/p>\n

    Reproduction, distribution, modification, publication, transmission or use of the contents of the platform without prior permission is prohibited, except as strictly necessary for personal use of the reservation.<\/p>\n

    16. Platform operation and liability limitations<\/h2>\n

    Oikos Servizi S.r.l. and the Municipality of San Teodoro undertake to keep the platform up-to-date, accessible and functional, taking all reasonable technical and organizational measures.<\/p>\n

    However, the platform is provided \"as is\" and there may be suspensions, slowdowns, malfunctions, temporary interruptions, technical errors or unavailability due to maintenance, upgrades, force majeure, network problems, third-party system failures or events beyond our direct control.<\/p>\n

    To the extent permitted by law, Oikos Servizi S.r.l. and the Municipality of San Teodoro shall not be liable for damages, losses or inefficiencies resulting from improper use of the platform, temporary unavailability of the service, errors in the data entered by the user, failure to receive communications due to causes not attributable to the operator or inability to access due to failure to comply with the conditions provided.<\/p>\n

    17. Links to third-party sites<\/h2>\n

    The platform may contain links to third-party websites or services, such as payment platforms, maps, information services, or other external tools.<\/p>\n

    Oikos Servizi S.r.l. and the Municipality of San Teodoro exercise no control over such sites or services and are not responsible for their content, terms of use, privacy policies, security or operation.<\/p>\n

    18. Changes to the Terms and Conditions<\/h2>\n

    Oikos Servizi S.r.l. and the Municipality of San Teodoro reserve the right to modify or update these Terms and Conditions at any time, including as a function of legislative, regulatory, organizational, technical or tariff changes.<\/p>\n

    The updated version will be posted on the platform and will be effective from the date of publication unless otherwise specified.<\/p>\n

    Reservations that have already been confirmed shall remain governed by the conditions in effect at the time of the relevant confirmation, unless changes are imposed by mandatory regulations, ordinances, measures of the competent authority, or safety and environmental protection requirements.<\/p>\n

    19. Language<\/h2>\n

    These Terms and Conditions are written in the Italian language.<\/p>\n

    Any translations into other languages are provided solely to facilitate user understanding. In case of discrepancies, doubts of interpretation, or translation errors, the Italian text prevails. <\/p>\n

    20. Applicable law and place of jurisdiction<\/h2>\n

    These Terms and Conditions are governed by Italian law.<\/p>\n

    The user agrees to comply with the beach access regulations approved by the City of San Teodoro, applicable ordinances, and any other applicable provisions, which shall be deemed an integral part of these conditions.<\/p>\n

    For any disputes, the criteria of jurisdiction provided by current legislation shall apply, without prejudice to the mandatory forum that may be provided for the protection of the consumer.<\/p>\n<\/div><\/div>\n<\/div>\n<\/div>\n\n
