1. Use of the website

This Site is available to all users (hereinafter referred to as “User” or “You”), subject to these General Terms and Conditions.
When you make a purchase on the Site or otherwise use the Site, you signify your acceptance of these Terms and Conditions.
Management of this booking platform and related beach entrance verification services is carried out by Oikos Servizi Srl.
You represent that he/she is an adult (at least 18 years of age) and has the legal capacity to be bound by this Agreement and to use the Site in accordance with these terms and conditions which he/she fully understands and accepts.
This site is solely and exclusively for the User’s personal use. It may not be modified, reproduced, duplicated, copied, distributed, sold, resold, or exploited for commercial or non-commercial purposes, except for the ability to print copies of one’s travel itinerary for personal use.
The User agrees not to use this website for illegal or prohibited purposes. In particular, the User agrees that he/she will use the website exclusively for him/her and that the services purchased through this website will be for his/her own personal use or consumption, or the use and consumption of the persons on whose behalf he/she is legally authorized to act.
The User may not resell the services purchased through this website to third parties.

2. Definitions

Unless otherwise indicated, the following terms and expressions shall have the following meanings:
– “User”, “you” and “your” refer to you as the purchaser of beach access made from this Site;
– “Confirmation of Reservation” has the meaning of transmission of the confirmation email;
– “Platform” refers to this site (also, the “Site”), the App, Widgets, tools, platforms or other devices intended for the management of reservations for access to the beaches Cala Brandinchi and Lu Impostu.
– “Reservation” means the reservation of beach beach access for a specific date, requested via Site, App or Widget;
– “Beach Regulations” the regulations approved by the Municipality of San Teodoro in effect on the date of reservation and/or use of the reservation;

3. Reservations and Confirmation

The Reservation submission process allows you to properly check and correct any errors before confirming your Reservation to us, so it will be your sole responsibility to ensure that the details of the Reservation are correct before submission.
Please note that the Reservation Agreement shall be deemed to be entered into when we send you the confirmation of the Reservation (usually by email: the “Reservation Confirmation”). The Reservation Confirmation shall mean your receipt from us which will give you the right to access the reserved beach.
The Reservation Confirmation shall be deemed to have been made with the sending of the confirmation email itself. We are therefore not responsible for the non-receipt of the same if it is blocked or entered into the receiver’s spam.
The applicant shall not be entitled to a refund and/or postponement, or in any case a change of date, of the reservation in case of bad weather on the day booked and in any other case. Therefore, the right of withdrawal is also excluded in accordance with Article 59 paragraph 1 of Legislative Decree 206 of September 6, 2005, as amended.
We reserve the right to deny access to our Site and/or App as well as the right to cancel Reservations if you fail our fraud prevention checks or if we have a reasonable suspicion of fraud or false reservations by you or anyone using your account.
Each reservation may not be requested for more than 6 people, and a single user may not make more than one reservation per day.
It is not necessary to include children under the age of 5 in the reservation (or pay the relevant fee).
The daily price is EUR 2.00 (two point zero) per person, except for the reductions provided for residents, Tari users, customers of accommodations, and the disabled.
Payment for the reservation can only be made online from this Site or the linked App using payment cards, including rechargeable cards. Payments will be processed through the Nexi platform and the data of the payment card used will not be stored by us. After the allocation of seats the user must make a reservation, if this is not done within 30 minutes the seats will be made available again to other users. The reservation can be used by the applicant and the same is not transferable to third parties in any form and for any reason, including free of charge.

4. Beach access

In order to access the beach, the user will have to show the control staff the QRCode, which can be downloaded by clicking on the link in the Reservation Confirmation or otherwise the reservation order number.
All persons included in the reservation must access the beach at the same time so there is no possibility of separate access or multiple uses of the QRCode or order number.

5. Exception to the right of withdrawal – cancellation Reservations
Once you receive the Reservation Confirmation, you will not be able to cancel the Reservation and receive a refund of the price paid for the Reservation.

7. Industrial and intellectual property rights

All content on the Site is the property of the City of San Teodoro of its Software and/or Content Providers, and is protected by national and international intellectual and industrial property laws.

8. Limitations of liability

Oikos Servizi Srl, the concessionaire, and the Municipality of San Teodoro offer this website “as is” and makes every reasonable effort to keep it up to date, maintained, and functioning, but makes no warranty as to any technical problems or that the system or portal will function at all times.

9. Links to other websites

The Site may contain links to other websites that are not operated by Oikos Servizi Srl. The latter exercises no control over these sites and is not responsible for their content.

10. Changes to the General Terms and Conditions

Oikos Servizi Srl and the City of San Teodoro reserve the right to modify and/or update these Terms and Conditions from time to time without notice to you. The current version of the Terms and Conditions will be displayed within the Website from the date the changes go into effect. Your use of the Website after any changes to the Terms and Conditions constitutes acceptance of those changes. These Terms and Conditions are drafted in the Italian language, the text of any translations, also published on this site, in other languages shall not be considered binding on Oikos Servizi Srl where it contains discrepancies or errors with respect to the Italian text.

11. Applicable law and jurisdiction

These General Terms and Conditions, are governed by the national and international regulations in force in Italy. In particular, the purchaser agrees and undertakes to comply with the regulations for access to the beaches approved by the Municipality of San Tedoro, which shall be considered an integral part of these conditions for all purposes.

Refunds

Kind users are informed that the reservation is non-refundable.

In case of erroneous and double payment made with the same email address and referring to the same day, the refund will be made by bank transfer within 30 days of the request.

To request a refund, simply send your request to the email address rimborsi@santeodorospiagge.it using the same email with which the reservation was made indicating the date of reservation, your iban and attaching an ID.

Cases of Bad Weather

In the event of bad weather, reservations made will not be postponed or entitle to a refund.
